Terms of Service

1. Acceptance of Terms

By accessing or using GaugeGrid ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

GaugeGrid is a vehicle maintenance tracking application that allows users to record, organize, and manage vehicle service history, maintenance schedules, and related information.

3. User Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use

4. User Content & License

All rights, title, and interest in GaugeGrid itself — including the software code and algorithms, the user interface design, our trademarks and logos, and our documentation and content — remain the exclusive property of GaugeGrid LLC.

You retain ownership of all content you create in the Service, including vehicle information, vehicle records and logs, photos, and documents. By using the Service, you grant us a limited license to store and process this content solely to provide the Service to you.

Analytics, calculated metrics, insights, and other information derived by the Service from your content are features of the Service and are not included in user-owned content or data exports.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use GaugeGrid for your own personal, non-commercial use or for the internal business operations of your organization, as applicable to your subscription plan. This license does not grant the right to resell, sublicense, or create derivative works from the Service. The full terms of your license are set forth in our End-User License Agreement.

5. Acceptable Use & Restrictions

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Upload malicious software or content
  • Violate the rights of others
  • Reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or business logic from the Service
  • Circumvent, disable, or interfere with security features or features that enforce limitations on the use of the Service
  • Access internal components of the Service (including local database structures, sync protocols, or configuration files) except through the Service's intended functionality
  • Use the Service, its outputs, or knowledge gained from using the Service to develop a competing product or service
  • Perform benchmark testing or competitive analysis without our prior written consent

6. Subscriptions and Payments

Some features require a paid subscription. By subscribing:

  • You authorize us to charge the payment method on file
  • Subscriptions auto-renew unless canceled
  • Refunds are handled according to App Store/Play Store policies
  • Prices may change with notice

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • The Service will meet your specific requirements
  • Any information provided is accurate or complete

GaugeGrid is a record-keeping tool. We do not provide automotive advice. Always consult qualified experts for vehicle-related decisions.

8. Fleet & Inspection Features

GaugeGrid's inspection features are tools to assist with vehicle inspection documentation. They are not a substitute for safe, conscientious driving or proper vehicle maintenance. The App is not a crash or accident avoidance or prevention system.

Regulatory Compliance Records — System of Record

GaugeGrid is a record-keeping tool — a system of record for information you enter. It does not request, submit, validate, grant, or verify any government registration, authorization, permit, or approval (including, without limitation, Colombia's RUNT / Ley 769 modification authorizations). Any regulatory data shown reflects only what you entered; GaugeGrid does not confirm its accuracy, validity, or legal sufficiency, and is not a compliance authority. You are solely responsible for obtaining valid authorization and for your regulatory compliance with all applicable requirements in your jurisdiction.

No Compliance Guarantee

GaugeGrid does not guarantee compliance with any federal, state, or local regulations, including FMCSA DVIR requirements under 49 CFR 396.11 and 396.13. It is the user's sole responsibility to ensure compliance with all applicable regulations.

Not Legal or Regulatory Advice

Information provided in GaugeGrid, including inspection templates and compliance features, is not intended as legal advice and is not a substitute for professional legal counsel regarding regulatory compliance.

Accuracy of Reports

The user accepts sole responsibility for ensuring the accuracy and suitability of all inspection reports and documentation generated by the App before submitting them to any agency.

Digital Signatures

The digital signature feature is provided as a convenience. The user is solely responsible for ensuring that electronic signatures comply with applicable federal and state electronic signature laws, including the ESIGN Act and applicable UETA provisions.

Fleet Operator Responsibilities

Fleet operators are solely responsible for obtaining all required consents from drivers and personnel before collecting personal data, location information, or digital signatures through the App.

Inspection Data Retention

Retention and deletion of inspection data are described in our Privacy Policy, including circumstances in which records may be retained to meet applicable regulatory requirements. Users are responsible for maintaining their own backup copies as required by applicable regulations.

9. Limitation of Liability

To the maximum extent permitted by law, GaugeGrid shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill. Our total liability is limited to the amount you paid in subscription fees in the preceding 12 months.

10. Termination

We may terminate or suspend your account at any time for violations of these Terms. You may request deletion of your account at any time by contacting our support team. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles.

13. Dispute Resolution

Informal Resolution

Please contact us first at support@gaugegrid.com to resolve any issues. We commit to good-faith efforts to resolve disputes informally.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. Arbitration will take place in North Carolina. Each party will bear its own costs, and arbitration fees will be shared equally unless the arbitrator determines otherwise. Either party may bring qualifying claims in small claims court as an alternative.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class, consolidated, or representative action.

Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to legal@gaugegrid.com within 30 days of creating your account.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, End-User License Agreement, and in-app Maintenance Disclaimer, constitute the entire agreement between you and GaugeGrid. In the event of any conflict between these website Terms and the Terms presented in the GaugeGrid app, the in-app Terms shall control.
